This high-profile matter concerns the issuance of a Withhold Release Order (WRO) by the U.S. Customs and Border Protection (CBP) against FGV Holdings Berhad over allegations of forced labour within its palm oil supply chain. On 30 September 2020, the CBP imposed the WRO on palm oil and related products manufactured by FGV, its subsidiaries, and joint ventures, effectively barring these goods from entering the U.S. market.| |We advised FGV on aligning its employment practices with Malaysian law and the International Labour Organization (ILO) standards, focusing particularly on the 11 ILO Indicators of Forced Labour, as outlined by the CBP. In collaboration with FGV and its US-based legal counsel, we provided comprehensive legal guidance to ensure compliance with local employment laws and international labour conventions, a critical component of FGV’s strategy to secure the removal of the WRO.| |FGV appointed an independent auditing firm to conduct a thorough assessment of its operations against the ILO forced labour indicators, as part of its commitment to rectifying identified concerns.
