Raëd Fathallah, Partner, is a member of the firm’s International Arbitration team. He acts as counsel in large-scale and complex investment and commercial arbitrations, in which he represents corporations, sovereign States and State entities.

Raëd Fathallah is also an accomplished arbitrator. He has served in more than 70 cases under the ICSID, ICC, LCIA, UNCITRAL, DIAC and CRCICA Rules, including as chairperson and sole arbitrator in over half of those cases. He is a Vice President and a Court member of the LCIA, a member of the ICC Commission on Arbitration and is also on the ICSID Panel of Arbitrators and Conciliators.

Whether as counsel or as arbitrator, he has been involved in more than 120 proceedings, both ad hoc or under the major Rules (including ICC, ICSID, LCIA, UNCITRAL, DIAC, BCDR, CRCICA and OHADA). He offers a harmonious blend of civil law, common law and Islamic law experience, spanning all continents, with a particular focus on the mining, oil and gas, and construction sectors.

Prior to joining Bredin Prat, he practised in New York, Montreal and Lebanon.

Formation académique

Raëd Fathallah is qualified as a Solicitor of the Supreme Court of England and Wales in 2005. He is a graduate of the University of Ottawa (L.L.L, 1994) and the New York University School of Law (M.C.J., 1996). He also obtained a Doctorate in Law (D.Phil, 2007) from the University of Oxford, Lincoln College, where his research principally focused on investment treaty arbitration.

Bredin Prat développe une pratique équilibrée entre arbitrages commerciaux et d’investissement. Le cabinet est mandaté par de nombreuses grandes entreprises françaises, et intervient aussi régulièrement aux côtés d’entités étatiques dans des arbitrages d’investissement (le Maroc, le Liban et l’Égypte sont des clients majeurs). Le volant d’affaires du cabinet est d’une nature très variée et couvre des problématiques de révision de prix de l’énergie, de télécoms, de construction, de contrats commerciaux et des différends post-acquisition. L’équipe traite aussi régulièrement des arbitrages en lien avec l’Europe de l’Est et a récemment remporté une grande victoire inédite pour l’état de Malaisie dans une procédure en annulation d’une sentence arbitrale d’un montant de 15 milliards de dollars.
