  • Acted for Unity Homes Ltd and its registered manager in a CQC prosecution. Successful in having five summonses withdrawn and the remaining Regulation 12 (safe care and treatment) charge resulted in a fine of £830.
  • Acted for a client in a long-running investigation arising out of a fatality following a wall collapse in 2018. Following a police investigation, inquest proceedings and written submissions to the HSE, the decision was made to take no further action against the employer company and director.
  • Acted for MES Dart & Partners in a HSE prosecution arising out of a workplace incident in April 2022 when an agricultural trailer collapsed on an employee performing maintenance. The sentencing hearing resulted in a fine of £32,000, significantly below expectations.

Gowling WLG

  • Representing a rail industry contractor in a four-day jury inquest following the death of a worker during track works. Other interested persons included the Office of Rail & Road, Network Rail and the Rail Accident Investigation Branch. No report to prevent future deaths was issued.
  • Advising an energy company in a workplace accident involving a driver of a vehicle being struck by mobile plant. This matter involving several duty holders is currently under investigation by the Health and Safety Executive.
  • Advising and representing a global manufacturer in enforcement action by the Office of Product Safety & Standards in relation to the fire rating of a construction product. This resulted in the team launching a rare appeal against enforcement notices using the provisions of the Construction Product Regulations.

  • Advising on the successful acquittal of a general manager in Chester Crown Court following a four-week jury trial regarding 15 broken backs and serious injuries to the public together with 270 other injury accidents over seven weeks at a new trampoline park.
  • Chris Green undertook all hearing and inquest advocacy at a five-day inquest into the death of a restrained holidaymaker who died and was asphyxiated during attempts by two security guards to apprehend him in a holiday park in North Yorkshire. Green’s client has not been prosecuted.
  • Advised on a prosecution against the owner and major shareholder director of a national pub. After a successful Crown Court application to dismiss, charges against the company were dropped by the local authority which had prosecuted for failings and food hygiene safety breaches found on a routine inspection of the premises.
